This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries Guidelines) Rules, 2011 that require publishing the Terms for access or usage of MWB Technologies India Pvt Ltd service via Jama Kharch (JK) app. This document meets the stipulations and conditions mentioned in Section 65B (2) of the Indian Evidence Act, 1872.
This Privacy Policy complies with:

Privacy issues are a high priority for us at MWB TECHNOLOGIES INDIA PRIVATE LIMITED and we follow standard industry practices to maintain your personal information. Please read the following to learn more about our privacy policy.
This privacy policy (“Policy”) explains our policy regarding the collection, use, disclosure, and transfer of your information by MWB TECHNOLOGIES INDIA PRIVATE LIMITED (CIN U72200KA2019PTC119955) or any of its affiliate(s) (“we” or “us” or “our”), which operates the “Jama Kharch App” (the “JK App”) available on various platforms, the Services and related mobile and software applications, whether existing now or in future.
This Privacy Policy forms part and parcel of MWB’s Terms of Use for JK App.
Capitalized terms which have been used here but are undefined shall have the same meaning as attributed to them in the Terms of Use. Users (as defined hereinafter) are requested to read this Policy in conjunction with the Terms of Use.
Please read this Privacy Policy before using the JK App or submitting any personal information. By using JK App, it shall be deemed that the User are expressly consenting to be bound by the terms and conditions described in this Privacy Policy. The User may revoke its consent for providing the sensitive information (as defined under Information Technology (Reasonable security practices and procedures and sensitive personal data or information) Rules, 2011) by reaching out to JK App support in writing and JK App may discontinue to provide services, which are depended on or requires such sensitive information.
JK App is for user’s resident in India only. Users who are Residents of any other country may not use the JK App or provide any information to JK App
Competency to contract
By agreeing to these Privacy Policy, a User (such User is a natural Person) represents that the User is at least the age of majority i.e. 18 years and is competent to contract. Additionally, where the User is registering on behalf of, and is the authorized representative of, a company, partnership or any other legal entity, such User has been duly authorized by such entity and is permitted under Applicable Laws to accept these Terms of Service. In case the User is a natural Person who is not of the age of majority or is not competent to contract, the User may not use the JK App or provide any information to JK App.
1. GENERAL
a. This Mobile Application with the name of Jama Kharch Appt (JK) ("App/MWB App/JK App") is operated by MWB TECHNOLOGIES INDIA PRIVATE LIMITED ("/We/Our/Us/MWB"). We are committed to protecting and respecting your privacy. We do collect your personal information and process your personal data in accordance with the IT Act, 2000 (21 of 2000) and other laws which relate the processing of personal data. Please read the following carefully to understand our views and practices regarding your personal data. The expressions “You” “Your” or “User(s)” refers to any person who accesses or uses the App for any purpose.
b. The JK App provides an online digital accounting book / bookkeeping services wherein the User(s), can record their accounting entries with their respective customers or record income and expenses or pass journal entries or record any accounting transactions.
c. Downloading, accessing, or otherwise using the App indicates that you have read this Privacy Policy and consent to its terms. If you do not consent to the terms of this Privacy Policy, do not proceed to download, access, or otherwise use the App.
d. Our privacy policy is subject to change at any time without notice. To make sure you are aware of any changes, please review this policy periodically. The last updated date can be found at the beginning of this policy. Any update in policy will be informed by push notifications and emails at least 7 days in advance.
e. We collect your personal information in order to provide and continually improve our products and services. You acknowledge that you are disclosing Personal Information voluntarily. Prior to the completion of any registration process on our App or prior to availing of any services offered on our App if you wish not to disclose any Personal Information you may refrain from doing so; however, if you don't provide information that is requested, it is possible that the registration process would be incomplete and/or you would not be able to avail of our services.
2. COLLECTION OF INFORMATION
Towards the provision of the Services and in cases where a User visits or uses the JK App, JK App shall collect the following information from a User (“User Information”):
INFORMATION GIVEN BY THE USER
The User may be required to give us information (including sensitive personal information) about the User when creating or using an account on a JK App, or when corresponding with JK App Customer Care by phone, e-mail or otherwise and keep an eye out for unauthorized activity on your accounts. The information you give us may include without limitation your name, photograph, postal address, e-mail address and phone number, Business entity information, location details or other information required by JK App to provide the Services and protect against any illegal activities. In an attempt to improve our Services, we may, from time to time, collect any information (other than what is mentioned above) from Users through App. We analyse the information we collect to understand user needs and to improve our websites and services. You may be assured that we do not share this data with any third party except in accordance with the terms of this Policy. We may also require additional information about a User in compliance of or as required under Applicable Laws.
All Information is service dependent, and we may use the Information to provide the Services, maintain, protect, and improve the JK app, and for developing new services.
We may also use your email address and phone number without further consent for non-marketing, or administrative purposes (such as notifying you of major changes, for customer service purposes, providing information about updates to JK App, other services, etc.). We use third party services for OTP generation for mobile and email verification.
We also obtain permission to access Device Camera and Photo Library For uploading photos and customizing the App experience. This data may be uploaded to the Company’s or a Service Provider’s servers or stored on your device. You can enable or disable access to this data at any time through your device settings.
Any Information provided by you will not be considered as personal information if it is freely available and/or accessible in the public domain or is not deemed as a personal information under the applicable law. Further, any reviews, comments, messages, blogs posted/uploaded/conveyed/communicated by Users on the public sections of the website, or an application store (like the App Store or Play Store) becomes published content and is not considered as personal information which is subject to this Policy.
In case you choose to decline to submit Information on the JK App, we may not be able to provide certain services on the App to you. We will make reasonable efforts to notify you of the same at the appropriate time. In any case, we will not be liable and or responsible for the denial of certain services to you for due to not receiving necessary Information from you.
When you register with the JK App, we may (at our discretion) contact you from time to time about updation of your Information.
Payment processing: When you subscribe to our paid services, we use Payment Gateway Service Providers, who will obtain sensitive information thru encrypted format for processing the payments.
INFORMATION AUTOMATICALLY TRACKED WHILE USING THE APP
We collect information primarily to provide better services to all of our customers.
We collect the following information from you when you use or signup on our App:
We may record conversations and archive correspondence between users and the representatives of the App (including the additional information, if any) in relation to the services for quality control or training purposes.
Log File Information: Our Servers automatically collect limited Information about your device's connection to the internet, including your IP address, when you use the App. We automatically receive and log Information from the App and/or your browser including but not limited to IP address, your device or computer's name, and your operating system, We may also collect log Information from your device, including but not limited to your location, IP address, time zone setting, your device's name, device's serial number or unique identification number (e.g. UDID on your iOS device, Android ID or ADID on your Android Device), your device operating system, browser type and version, CPU speed, and connection speed etc, material or information viewed or searched by the User; page response times, download errors, length of visits to certain pages, page interaction information, methods used to browse away from the page, metadata such as location, date etc., and details of email address or phone number used to contact customer service.
Cookies: To improve the responsiveness for our Users, we may use " functional and or analytical cookies", App log files or similar electronic tools to collect information to assign each visitor a unique, random number as a User Identification (User ID) to understand the User's individual interests using the identified computer. Cookies are small data files stored on your device. Among other things, cookies help us for analysing and optimising our App, our marketing activities, and your experience. We use cookies to see which areas and features are popular and to count visits to our App. Additionally, you may encounter "cookies" or other similar devices on this App that are placed by third parties. We do not control the use of cookies by third parties.
By continuing to visit the App, you are agreeing to the use of cookies and similar technologies for the purposes we describe in this Policy. If you prefer not to receive cookies or web beacons, then you should stop using Services, or consult your browsing and third-party cookie settings.
We automatically collect information using "Cookies" and to monitor user registration, to recognise registered Users when they revisit the app and to track app usage.
By using this App, you are agreeing that We may advertise your feedback on the App and other marketing materials.
We will retain your information as long as we require this to provide you with our services and for such period as mandated by the concerned laws.
If you opt to receive marketing correspondence from us, subscribe to our mailing list or newsletters, participate in any of our competitions or provide us with your details at networking events, we may use your personal data for our legitimate interests in order to provide you with details about our goods, services, business updates and events.
Unless otherwise stated explicitly, this Policy applies to Personal Information as disclosed on any of the Media.
User may update, correct, or confirm provided information by logging on to their accounts on the app or by sending a request to support@wbtechindia.com. The requested changes may take reasonable time due to verification process and server cache policies.
Users may also choose to delete or deactivate their accounts on the app. We will evaluate such requests on a case-to-case basis and take the requisite action as per applicable law. In this regard, please note that information sought to be deleted may remain with us in archival records for the purpose of compliance of statutory enactments, or for any other lawful purpose. Therefore, users are requested to carefully evaluate what types of information they would like to provide to us at the time of registration.
We keep your personal information for as long as it is required for the purposes stated in this Privacy Policy. When we no longer have a legitimate need to process your information, we will delete, anonymize, or isolate your information, whichever is appropriate.
All calls to MWB are completely confidential. However, your call may be recorded to ensure quality of service. Further, for training purpose and to ensure excellent customer service, calls from MWB may be monitored and recorded.
3. HOW WE USE INFORMATION
a. We use the information we collect primarily to provide, maintain, protect, and improve our current products and services.
b. to customize the content you see.
c. to fulfill your requests for certain services, and to contact you about our services via including but not limited to email's, sms’s and other means of communication.
d. We use the information collected through this App as described in this policy and we may use your information to:
i. Register on JK app
ii. Improve our services, App and how we operate our businesses.
iii. to facilitate the User’s requests and the Services
iv. Understand and enhance your experience using our App, products, and services.
v. Personalize our products or services and make recommendations.
vi. Provide and deliver products and services you request.
vii. Provide customer support and respond to your requests, comments, and inquiries.
viii. To send you transactional emails/SMS or to provide you with information, and other materials regarding JK App or other products of MWB and or its associates.
ix. Create and manage the online accounts you manage on our App.
x. Determine your geographic location, allow you to continue watching/using previous content at another time, and to determine your Internet service provider to troubleshoot a technical issue, and help us quickly and efficiently respond to inquiries and requests.
xi. for conducting audits and for record keeping purposes
xii. Send you related information, including confirmations, invoices, technical notices, updates, security alerts and support and administrative messages.
xiii. To aid strategic development, data collection and business analytics for JK App or its partners
xiv. Communicate with you about promotions, upcoming events and news about products and services.
xv. To respond to your queries or feedback submitted by the User
xvi. We may process your personal information without your knowledge or consent where required by applicable law or regulation for the purposes of verification of identity or for prevention, detection, or investigation, including of cyber incidents, prosecution, and punishment of offences.
xvii. To take up or investigate any complaints/claims/disputes
xviii. Protect, investigate, and deter against fraudulent, unauthorized, or illegal activity.
xix. To detect and prevent fraudulent transactions and other illegal activities, to report spam, and to protect the rights and interests of JK App users, third parties and the public;
e. Personal Information will be kept confidential and will be used for our strategic client analysis objectives and other internal business purposes only.
We will share Personal Information only under one or more of the following circumstances: - If we have your consent or deemed consent to do so - If we are compelled by law (including court orders) to do so.
In furtherance of the confidentiality with which we treat Personal Information we have put in place appropriate physical, electronic, and managerial procedures to safeguard and secure the information we collect online.
We will use your Personal Information with your explicit consent as follows:
Whenever the law requires us to get your permission or where we have stated we may seek your permission in this Privacy Notice. In some contexts, we use your Personal Information where we have a legal obligation to do so or to protect your vital interests or those of another person:
• Prevent, detect and investigate potentially prohibited or illegal activities, including fraud, and enforcing our terms (such as determining free trial eligibility);
• Confirming your identity if you are exercising legal rights.
• Notify you about changes in the Terms of Use or in this Privacy Notice.
We give you the ability to edit your account information and preferences at any time, including whether you want us to contact you about new services. To protect your privacy and security, we will also take reasonable steps to verify your identity before granting access or making corrections.
4. INFORMATION STORAGE AND BACKUP
Storage of User Information
User Information in the possession and control of JK App is stored in accordance with Applicable Laws. Storage and transfer of User Information is carried out in compliance with all Applicable Laws, including without limitation, the Information Technology Act, 2000 and the Information Technology (Reasonable security practices and procedures and sensitive personal data or information) Rules, 2011 and other applicable laws. By using JK App or Services, the User agrees and consents to the collection, storage and use of the User Information collected in the manner described in and in accordance with this Privacy Policy.
Information security
JK App takes various reasonable steps and measures to protect the User Information provided by a User from misuse, loss, unauthorised access, modification, or disclosure. These include internal reviews of our data collection, storage and processing practices and security measures, including appropriate encryption and physical security measures to guard against unauthorized access to systems where we store personal data. All Information gathered on the JK App is encrypted and securely stored within the controlled database. Access to the servers is password-protected and is strictly limited.
Our security measures are regularly reviewed and updated to reflect technological developments. Regardless of where your personal information is transferred or stored, we take all steps reasonably necessary to ensure that personal information is kept secure, however, please understand that no transmission of data over the internet or any other public network can be guaranteed to be 100% (one hundred percent) secure.
We use industry-standard secure server layers encryption and access control on its systems, and other reasonable security practices and procedures. Do note that while JK App makes best possible efforts to securely store the User Information and data provided by a User, JK App does not guarantee that there will be no unintended disclosures of the User Information and data provided by a User on account of a data breach, unauthorized access, security failure etc. JK App cannot guarantee, give no warranties, and shall not be liable for breach of the security of User Information through the JK App due to malicious attacks, errors, commission, or omissions not wilfully initiated by JK App and any transmission is at the risk of the User.
We seek to ensure compliance with the requirements of the applicable data protection laws to ensure the protection and preservation of the User’s privacy and personal Information. We have physical, electronic, and procedural safeguards that comply with the laws prevalent in specific jurisdiction to protect User’s Personal Information. By accepting the terms of this Policy, you agree that the standards and practices being implemented by us, are reasonable and sufficient for the protection of your personal information.
We will contact you regarding any breach of the security, confidentiality, or integrity of your unencrypted electronically stored Personal Information to you via email or any other feasible manner in the most expedient time possible and without unreasonable delay, insofar as consistent with the legitimate needs of law enforcement and will undertake all measures necessary to determine the scope of the breach and restore the reasonable integrity of the data system.
Local storage policy
All user data collected via the JK App will be stored and processed on servers located within India, in compliance with the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 and other applicable laws. Data transfers outside India, if any, will occur only with explicit user consent and adherence to applicable laws.
Data Backup
From time to time, we take backup of your data on JK App on our cloud database. This is done for the purpose of enabling Users to get their data back in case their phone's data becomes unusable, or phone gets lost, or the User moves to a new phone device.
JK App may, at its discretion, retain any User Information for as long as a User is active on JK App, as required under agreements with JK App or as require under Applicable Laws. JK App shall not be responsible for any destruction of any User Information after the closure or termination of a User’s account with JK App.
5. DATA TRANSFER
a. Information about our user is an important part of our business and we take due care.
b. The User consents to sharing of Information (including sensitive personal information) when it is requested or required by law or by any court or governmental agency or authority to disclose, for the purpose of verification of identity, or for the prevention, detection, investigation including cyber incidents, or for prosecution and punishment of offences. These disclosures are made in good faith and belief that such disclosure is reasonably necessary for enforcing the Terms of Use or for complying with the applicable laws and regulations.
No personal information of an individual User such as name, phone number, email address, spends data, etc. would be shared with any other User and/or third party unless explicitly approved by the concerned individual User himself/herself. We may also present information related to credit records, User spends, patterns and User data tracked by us only in the form of aggregated statistics on data such as overall app usage by date, time, balances, etc. within our App to our partners.
c. We release account and other personal information when we believe is appropriate to comply with the law, enforce or apply our conditions of use, and other agreements, protect the rights, property or safety of Us, our users, or others. This includes exchanging information with other companies and organizations for fraud protection and credit risk reduction.
d. MWB reserves the right to share recordings of all phone calls made between the user and customer care to legal, accounting, or other advisors that provide professional services and / or who assists us in training, quality monitoring and quality enhancement of our services to the user and / or service providers. You hereby grant your irrevocable consent to MWB to share such call recordings to third parties for such purposes. You further disclaim and / or abandon any right to sue MWB in relation to the same. Such third parties shall be bound by strict confidentiality agreements which limit their use of such information.
6. DATA SECURITY
a. We prioritize the protection of customer data and implement robust technical measures to prevent unauthorized or unlawful access, as well as accidental loss, destruction, or damage. Our employees handling data are thoroughly trained to safeguard it against any illegal or unauthorized use. To enhance security, all data is encrypted end-to-end.
b. We maintain physical, electronic, and procedural safeguards in connection with the collection, storage, and disclosure of personal customer information.
c. We take reasonable steps to help protect your personal information in an effort to prevent the loss, misuse, and unauthorized access, disclosure alteration and destruction. It is your responsibility to protect your usernames and passwords to help prevent anyone from accessing or abusing your accounts and services. You should not use or reuse the same passwords you use with other accounts as your password for our services.
d. It is important for you to protect against unauthorized access to your password and your devices, and applications. Be sure to sign off when you finish using a non-personal device.
e. Information you provide to us is shared on our secure servers. We have implemented appropriate physical, technical and organizational measures designed to secure your information against accidental loss and unauthorized access, use, alteration, or disclosure. In addition, we limit access to personal data to those employees, agents, contractors, and other third parties that have a legitimate business need for such access.
f. Information collected from you will be stored for such period as required to complete the transaction entered into with you or such period as mandated under the applicable laws.
7. LINKS TO THIRD PARTY SITE/APPS
Our App may, from time to time, contain links to and from other Apps/Websites of third parties. Please note that if you follow a link to any of these Apps/Websites, such Apps/Websites will apply different terms to the collection and privacy of your personal data, and we do not accept any responsibility or liability for these policies. When you leave our app, we encourage you to read the privacy policy of every App/Website you visit.
8. SOCIAL NETWORK PLUGINS
This App incorporates plugins and/or buttons for social networks, in order to allow easy sharing on your favourite social networks. These plugins are programmed so as not to set any cookies when assessing the page to safeguard the privacy of users. Cookies may be set if you make voluntary use of the plugin. The collection and use of information obtained by means of the plugin are governed by the respective privacy policies of the social networks.
9. REVOCATION OF CONSENT
A User can revoke his consent to the processing of his personal information at any time with effect for the future. Please note that withdrawing consent does not affect our right to continue to collect, use and disclose personal information where such collection, use and disclose without consent is permitted or required under applicable laws.
10. CHANGES TO THIS POLICY
We may change this policy from time to time. If we make any changes to this policy, we will change the "Last Updated" date above. You agree that your continued use of our services after such changes have been published to our services will constitute your acceptance of such revised policy. We may also make reasonable efforts to inform you via electronic mail or push notifications. In any case, you are advised to review this Policy periodically on the Site to ensure that you are aware of the latest version.
11. BUSINESS TRANSFERS
We do not intend to sell our business. However, in the unlikely event that we sell our business or get acquired or merged, we will ensure that the acquiring entity is legally bound to honour our commitments to you. We will notify you via email or through a prominent notice on our website of any change in ownership or in the uses of your personal information and service data. We will also notify you about any choices you may have regarding your personal information and service data.
12. ENFORCEMENT OF OUR RIGHTS
We may disclose personal information and service data to a third party if we believe that such disclosure is necessary for preventing fraud, spam filtering, investigating any suspected illegal activity, enforcing our agreements or policies, or protecting the safety of our users.
13. LEGALITIES
· All the JK App Services are currently provided and regulated by MWB TECHNOLOGIES INDIA PRIVATE LIMITED and therefore MWB TECHNOLOGIES INDIA PRIVATE LIMITED is responsible for the collection, storage, and processing of personal information of the Users.
· All Users are reminded that they may be held legally accountable for what they say or do online. In particular, Users may be held liable for any defamatory comments, threats and / or untrue statements or other illegal and fraudulent claims made by them.
· MWB does not endorse the opinions expressed by its Users.
· If any User fails to observe the above rules of conduct at any time, MWB reserves the right to terminate the membership of the User and / or delete all their contributions (either temporarily or permanently) from the App, depending on the nature and severity of the breach and without prior warning or consent of the User.
· Registration as a User of this App at any time past or present and use of the App and all its product / service offerings will be taken as acceptance of the above rules of conduct. MWB's decision on all matters is final and binding on its Users.
· Legal jurisdiction for all disputes is the Court of Hubli (Karnataka), India.
· You can reach TEAM MWB anytime by writing to support@wbtechindia.com and we will respond to you in a timely manner. We hope you have an enjoyable and rewarding experience on the App.
14. NEWSLETTER
Following subscription to the newsletter, your e-mail address is used for our advertising purposes until you cancel the newsletter again. Cancellation is possible at any time. The following consent has been expressly granted by you at the time of registration (I am accepting to receive newsletter from this App), you may revoke your consent at any time with future effect. If you no longer want to receive the newsletter, then unsubscribe by clicking on unsubscribe option given in the email footer.
